Shanker spoke on the panel Merger Regulations and their substantial development over the past 5 years (since its enforcement) from a competition standpoint.  They discussed issues emerging during this period of enforcement like “gun-jumping”, standards of review, exemptions, target thresholds, etc.

Shanker spoke on a panel entitled Efficient Competition Regulation: Addressing the “Challenges” of Due Process.  One of the significant issues to be discussed at the roundtable was setting the future of efficient competition regulation; the panel additionally gaged global perspectives and tabled an informed view on current issues in competition regulation in India. 

The session focused on the following sub-themes:

  • The basis for “due process” rules in CCI proceedings
  • The contribution of the COMPAT and the courts
  • Avoiding “abuse” of “due process”
  • Striking a balance
